
A Daniel Island family has basically been run out of their home due to mold spores growing throughout the structure. And this is no small matter. The mold is in the walls, under the carpets. The house is pretty much toxic, apparently, and the owner, Benjamin Allen, says it’s worthless. The Allens have asked homebuilder D.R. Horton to do something about it, but they’re still waiting on the company to send out an inspector to look at the damage.
From ABC News 4:
“She’s had severe respiratory infections and has been in and out of emergency rooms seeing doctor after doctor. They’re trying to narrow down what is causing this,” Allen added.

“When the mold inspector came out, he was shocked,” Allen said.

Mold is growing behind the walls so fast that if someone took off the tape, spores would come flooding out and add to the toxic levels in the home. The Allens were forced to leave everything behind.
The Allens aren’t the first to complain to D.R. Horton about the company’s homes, either. ABC News 4 says that at least 15 other lawsuits are pending against the homebuilder.

Whether or not one believes mold can hurt people, there’s no doubt that a house that leaks and has mold is rotting from the inside out. This is serious, expensive damage and no new home should be having these problems. The homebuilding industry has been taking shortcuts and using unskilled labor, sometimes these new houses don’t even meet the barest minimum legal requirement—the building code. Codes aren’t well enforced, and neither is the law.
When people try to hold a bad builder accountable they are often hampered by arbitration clauses in contracts and “warranties” which prohibit suing, or they can’t find a lawyer to help them because these cases are notorious money pits for law firms. Contrary to the popular notion that homeowners can win jackpot awards even with trivial concerns, the reality is that one’s legal recourse in construction defects is slim. Few cases will end up as class actions because of the strict requirements to meet the status of a “class” that the homeowners would have to have.
The building industry has been able to get away with this for years, by lobbying to reduce codes and consumer protection, by contractual waivers of rights that consumers don’t fully understand, and by widespread shortcuts that become industry standard and thus “accepted practice.”
I feel for these homeowners and hope that they’ll find resolution. Thank you for the media exposure. Let’s just hope readers listen.

TOXIC MOLD has destroyed one well known defective Project in San Luis Obispo, CA RANCHO OBISPO built by now con man Ron Hertel and Robert JS Fowler of Ventura, CA has been a 4 year nightmare according to over 27 owners effected. The CSLB investigated and found all 100% of the homes inspected to be defective, so bad the CSLB issued a National Press release on them. Today the CSLB is pursuing there license for revocation for failure to pay court ordered Civil judgments not to pass up the fact that Point Center Financial of Southern Calif. has issued a Notice of Default on over 20 Million dollars of loans to RW Hertel & Sons dba Atascadero Ventures, LLC Hertel is now a well documented Con Man and cheat. Buyer and Investors Beware…
